Safety Disclaimer and Limitation of Liability
SpikeCamp is not an official or government alert service. While SpikeCamp does aggregate and parse news and alerts from a number of government/official sources, SpikeCamp itself does not dispatch assistance, and does not issue evacuation orders. Data may be delayed, incomplete, or inaccurate. GPS, offline maps, and mesh radios can fail. Call 911 for a life-safety emergency.
If you are in danger, or you have been told to leave, leave. Call 911 for a life-safety emergency. Follow official evacuation orders, incident command, and the responsible agency. Do not wait for a push notification, a map refresh, or a family check-in.
Ultra Labs LLC, publishes SpikeCamp at spikecamp.app and spikecamp.vercel.app. Contact: ops@spikecamp.app.
1. Not an official system
SpikeCamp is not:
- 911, dispatch, or an emergency-alert originator.
- An Incident Command System, an Incident Action Plan, or a substitute for the official IAP map.
- IPAWS, a Wireless Emergency Alert, or a county emergency-management system.
- A TAK (Team Awareness Kit) server or any other official fire, law-enforcement, or aviation system.
- Air-traffic control, flight following, or aircraft deconfliction. Aircraft icons are crowdsourced ADS-B when that layer is on. They are late, they drop targets, and they are not for separation.
- A medical service. A “medic” pin is a crew note, not a request that reaches an ambulance.
- A heart-rate display, a manual vitals note, or a local threshold banner. Those stay on the phone that recorded them. They are not a diagnosis, not a feed to command, and not a call to a medic.
Crew pins are labeled unofficial. They are not orders. A family link is a delayed, coarse status a firefighter chose to share. It is not a location tracker and it is not an all-clear.
2. Data can be delayed, incomplete, or wrong
Fire locations, acres, containment, perimeters, hotspots, air quality, smoke, Red Flag warnings, evacuation zones, shelters, new-start reports, weather, temporary flight restrictions, and aircraft positions come from other organizations on their own schedules. Any of them can be hours old, geometrically wrong, or missing. A perimeter is not a survey. An evacuation polygon in the app is not the order. The order is what the sheriff, fire agency, or emergency manager issued. “No zone on the map” does not mean “no order.”
Satellite hotspots are not confirmed fires. AirNow values are preliminary. WildCAD lines are dispatch-board copies, not a size-up. Offline packs and “last saved” banners are stale by definition.
Alerts are generated by software from those feeds. A person does not review each one before it is sent. An alert can be wrong, duplicated, or late. Quiet hours never block an evacuation-order alert in the product rules, and that rule can still fail if the device, the browser, or the push service fails.
3. GPS, mesh, and offline maps fail
Phone GPS drifts, drops in canyons and under canopy, and lies when the radio is off. Follow-my-location is a camera aid on the device. It is not a track that incident command can see.
This build does not open a Meshtastic or other mesh radio. A mesh network you run yourself can lose packets. Do not plan a medical or evacuation message around it.
A Bluetooth heart-rate strap in the browser stops when that page is hidden or the screen sleeps. It is not a watch, and it is not monitored by anyone else.
Offline map packs omit what they do not contain. Tiles, roads, and drop points can be old. A saved pack does not update in a dead zone. If the screen and the ground disagree, trust the ground and the official map you were briefed on.
4. Your judgment
You are responsible for how you use SpikeCamp. Cross-check anything that matters with the official source named on the screen (NIFC, the county, NWS, InciWeb, the dispatch center, FAA) and with the people who have authority on the incident. The app is a supplement to that, not a replacement.
5. Warranty disclaimer
SPIKECAMP IS PROVIDED “AS IS” AND “AS AVAILABLE.”
To the fullest extent the law allows, Ultra Labs disclaims every warranty, express, implied, or statutory, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, timeliness, quiet enjoyment, and any warranty that the service will be uninterrupted, secure, or error-free. We do not warrant that a feed, a GPS fix, a push notification, an offline pack, or a pin is correct or that it will arrive in time.
Some states do not allow an implied-warranty disclaimer. In those states the disclaimer applies to the fullest extent allowed. You may have rights that cannot be waived.
6. Limitation of liability
To the fullest extent the law allows, Ultra Labs and its members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, death, property damage, or the cost of substitute services, arising out of or related to SpikeCamp or these terms, whether the claim is in contract, tort, statute, or otherwise, and whether or not we were advised of the possibility.
To the fullest extent the law allows, our total liability for all claims in the aggregate will not exceed the greater of (a) the amount you paid Ultra Labs for SpikeCamp in the twelve months before the claim or (b) one hundred U.S. dollars (USD $100).
These limits do not apply to liability that Washington law, or another law that cannot be waived, does not allow us to limit. That includes, where a court says so, liability for gross negligence or willful misconduct, and certain injury claims. If you are a consumer, a mandatory consumer protection statute controls over this section where they conflict.
We are not liable for a decision to stay, to go, to fly, or to send someone, that you or someone else made using or failing to receive information in SpikeCamp. The official order and the people on scene control.
7. Indemnity
You will indemnify Ultra Labs as described in the Terms of Service. In short: you cover claims that come from your content, your misuse, or from presenting SpikeCamp as an official system. You do not cover a claim a court finally decides was caused by our gross negligence or willful misconduct.
8. Acknowledgement
The app asks you, once per version of this notice, to acknowledge the statement at the top of this page. That acknowledgement is stored on the device with a version string (2026-10-17-draft-1) so a later change can ask again. The acknowledgement does not make the service safe, and it does not waive a right the law says you cannot waive.
